Paediatric negligence arises with errors in the medical treatment of children.  The circumstances where these types of claims can arise include:

  • Cerebral palsy
  • Birth injuries
  • General medicine
  • Delayed diagnosis of hip dysplasia which arises when the hip socket does not fully cover the ball joint of the upper leg. Essentially, the hip joint is dislocated and if this is not diagnosed early enough can result in permanent injury
  • Mistakes treating children with disease and illness early in their life
  • Neurological disorders in babies or young children such as brain injury or hypoxia which is deprivation of oxygen
  • Mistakes dealing with hormone problems in children
  • Developmental mistakes such as failure to diagnose learning disability and physical disability
  • Failing to diagnose, in a timely manner, and treat serious and fast spreading infections such as meningitis, septicaemia and tuberculosis (TB)
  • Failing to diagnose and consequently treat respiratory problems such as asthma
  • Failing to appreciate the significance of headaches and/or reduced sight which in turn leads to delay in diagnosing tumours
  • Incorrectly administering drugs or a dosage of drugs which results in harm or possibly death
  • Failing to diagnose fractures in children which when left generate lifelong abnormal bone growth
  • Failure to treat leukaemia appropriately
